Vianet Website Privacy Statement

The following privacy statement applies to all information collected about identifiable individuals through the Vianet website (the “Website”). The Vianet Website is owned and operated by Trade Me Limited (“Trade Me”). By viewing and using the Website you will be deemed to agree to this privacy statement. If you do not agree to this privacy statement you should stop accessing and using the Website.

1. Collection: Trade Me gathers various information about people who access and use the Website, including:
   1. personal information provided as a result of you viewing and/or booking the services of tourism operators who advertise and sell services through the Website, including but not limited to your email address, SMS number and credit card information;
   2. personal information provided by you through any other method (including without limitation your correspondence and discussions with Trade Me, with the tourism operators who advertise and sell services through the Website (“Operators”) or with the retailers who assist you to book Operator services or whose websites you use to access the Website (“Retailers”);
   3. personal information collected by us through click tracking in relation to your use of the Website, including the content you access;
   4. aggregated data, which tracks traffic to the Website but do not relate to you personally; and
   5. cookies, which are pieces of information transferred to your computer hard drive for record keeping (such as your preferences on the Website). You can choose to refuse cookies by turning them off in your browser and/or deleting them from your hard drive. You do not need to have cookies turned on to use the Website, but you may need them for customizable areas of the Website that Trade Me may develop in the future.


2. Purposes of Use: The personal information you provide will be used for the following purposes:
   1. to verify your identity and assist you if you forget any password or login details;
   2. to provide you with information on, and enable you to book, Operator services;
   3. to provide you with further information about the Website or other websites or goods or services offered by us or third parties which Trade Me considers may be of interest to you;
   4. for future marketing, promotional and publicity purposes, including direct marketing, market research, surveys and statistical purposes;
   5. for ensuring that you are shown the information that is most relevant to you and your interests; and
   6. for any other use that you authorise.
   Additionally, Trade Me may disclose all of the information that it collects to Operators and Retailers in relation to the provision to you of Operator services you book. Additionally, Trade Me may disclose to third parties any information that Trade Me gathers about you for the purposes of meeting the requirements of the New Zealand government and its sanctioned agencies or departments and aggregate tracking information and other information that does not personally identify you.


3. Consequences of non-provision of information: Failure to provide necessary personal information when requested may result in certain services not being available to you, including without limitation you being unable to book Operator services, receive the benefit of Operator services you have booked or obtain a refund for booked Operator services where this is available pursuant to the terms of your agreement with the relevant Operator.


4. Content Providers, Advertisers and Partners: Trade Me does not control the practices of all content providers, partners and advertisers connected with the Website and to whom you provide personal information whilst using one of their sites or services. The website contains links to other sites, which may not follow the same privacy policies as per the Vianet Website. Trade Me recommends that you check any relevant privacy policies before providing your personal information to any third party.


5. Opting in and Opting Out: If Trade Me’s intended collection, use or disclosure of your personal information is outside the collection, use or disclosure set out in this privacy statement Trade Me will give you the option: (a) to opt out and not receive certain services or participate in certain interactive areas; or (b) to opt in to agree to be contacted by Trade Me in relation to certain matters such as notification of new features to the Website or promotional activities.


6. Holding, Correcting and Updating: Any personal information that you provide through the Vianet Website will be collected and held by Trade Me. If you are an individual, under relevant privacy legislation (such as the Privacy Act 1993 in New Zealand), you may have rights of access to and correction of personal information that Trade Me holds. Trade Me offers the ability to access, correct and/or change the information collected at any time and as often as necessary by signing into your Vianet account using the login link on the home page.
