Terms and Conditions of Use of Vianet’s Website

These terms and conditions of use apply to all users of the Vianet website (the “Website”). The Vianet Website is owned and operated by Trade Me Limited (“Trade Me”). By viewing and using the Website you will be deemed to agree to these terms of use without qualification. If you do not agree to be bound by these terms then you should stop accessing and using the Website.

1. Copyright and Limited Reproduction Notices: The design of and all content appearing on the Website are the copyright of Trade Me or suppliers to it. No part of the Website may be:
   (a) distributed or copied for any commercial purpose, nor incorporated in any other work or publication (whether in hard copy, electronic or any other form); or
   (b) resold, published, modified, enhanced, copied, reproduced, transmitted or stored (including in any other website or other electronic form) except that you may print, or download to your hard drive, extracts from the Website only for your own personal use, without the express permission of Trade Me.


2. Trademarks: The Vianet Terrain Device is the registered trade mark of Trade Me and must not be used without Trade Me’s express authorisation.


3. Hyperlinking: Trade Me reserves the right to prohibit links to the Website and you agree to remove or cease any link upon our request. You may not frame any part of the Website material by including advertising or other revenue generating material.


4. Links Provided: The Website includes links to third party materials, including materials of tourism operators (“Operators”) advertising their tourism services and making such tourism services available to be booked (“linked materials”). Trade Me will not be responsible for the contents of any linked materials or liable for any direct or indirect loss or damage suffered by you from accessing, using, relying on, booking or purchasing the services of Operators or other third parties. Linked materials are provided to you only as a convenience, and the inclusion of any link does not imply our endorsement of the site or any association with the people who run or manage those sites. Any tourism services you book through this site will be will be provided by the relevant Operator and not by Trade Me.


5. No guarantee of continuity: Trade Me may temporarily suspend or restrict the Website to perform maintenance. Trade Me does not warrant that the website will be continuously available or that the operation of the Website will be virus or error free or that any communication made through the Vianet System will be secure.


6. Advertisers: Any dealings with any advertiser appearing on the Website are solely between you and the advertiser or other third party. Trade Me is not responsible or liable for any part of any such dealings or promotions.


7. Security: As no data transmission over the Internet can be guaranteed to be completely secure, we cannot ensure or warrant the security of any information you transmit or receive through the Website. Credit card information that is transmitted via our secure servers is encrypted to minimise the risk of unauthorised use of such information.


8. Limitation of Liability: Whilst reasonable care has been taken to ensure the facts stated in the Website and the descriptions of tourism services on the Website are accurate and the opinions given are fair and reasonable, Trade Me does not give any warranty of accuracy or reliability of information to you or any other person. To the fullest extent permitted by law, but without limiting any rights you may have under the Consumer Guarantees Act 1993, Trade Me and its affiliates exclude all responsibility and liability in relation to the Website and any Operator services viewed or booked on or through the Website, Trade Me and its affiliates will not be responsible for errors or misstatements or be liable whether in contract, tort (including negligence) or otherwise for any loss or damage however caused (whether direct, indirect, consequential, special, or loss of profits). Any concerns you have in relation to the information on Operator services or in relation to the booking of an Operator service should be directed to the relevant Operator.


9. Changes to Terms of Use: Trade Me reserves the right to change these terms and conditions of use at any time. Where changes are made, we will update the notification of when the terms and conditions were last updated, so you know whether you need to reread them. By continuing to access the Website, you agree to be bound by the amended terms and conditions.


10. Privacy: By viewing and using the Website you will be deemed to agree to the Vianet Website’s Privacy Statement . If you do not agree to the Privacy Statement you should stop accessing and using the Website.


11. Law: These terms and conditions are governed by and will be construed in accordance with the laws of new Zealand and you submit to the jurisdiction of the courts of New Zealand.
